Rep. Donna Scheuren of Montgomery County has expressed dissatisfaction with House Democrats for tabling her proposed amendments to Senate Bill 1236. These amendments aimed to strengthen anti-squatter legislation in Pennsylvania.
"This week, House Democrats missed an incredible opportunity to increase protections for homeowners, property owners and landowners across Pennsylvania," Scheuren stated. She explained that her amendments would have allowed police to remove squatters from homes immediately upon receiving a signed affidavit from the homeowner. However, the Democrats decided to table these amendments indefinitely without discussion.
Scheuren noted that her proposals were a simplified version of her original bill, which she called the Homeowner Protection and Squatter Eviction Act. This act is also known as House Bill 2237 and includes several measures:
- It allows law enforcement officers to remove squatters if the homeowner provides an affidavit confirming ownership.
- The person signing the affidavit could face penalties if found not to be the owner.
- Squatters causing over $1,000 in damage would face first-degree felony charges.
- Homeowners could seek treble damages and attorneys' fees through civil action against squatters.
- Law enforcement must notify Immigration and Customs Enforcement (ICE) if a squatter is an illegal immigrant.
"While I voted to pass because it does change the legal definition of a 'squatter' to a 'trespasser,' it is disappointing we missed this great chance to do more for homeowners," Scheuren remarked. She emphasized the need for real action against squatters by advancing her proposed act through legislative processes.
The Homeowner Protection and Squatter Eviction Act currently awaits further consideration in the House Judiciary Committee.
